Terms and Conditions 

1. Prize Draw & Incentive Details 

These terms apply to any Heart of London Business Alliance prize draw and competition or survey, consultation, feedback exercise or research project where an incentive is offered to eligible participants, unless stated otherwise. 

For each competition or prize draw, HOLBA will make details available before entry, usually in the invitation, landing page or accompanying materials. These details will include, but are not limited to, the following: 

  • Incentive details including type, quantity and restrictions eg. Prize draw/ guaranteed reward / voucher / gift / charity donation / other with the number to be awarded, and any restrictions on usage
  • Entry or qualifying-completion requirements eg. Details on how to enter or if entry is automatic on completion, and any age or other qualifying requirements  

The prize draw or incentive date is the date when it was communicated eg. Sent via email to target recipients or made available as a link on a website or other public channel. 

The prize draw or incentive close date is the date specified as the deadline for completion or other communicated date for submission of entries. 

2. Promoter 

The promoter is Heart of London Business Alliance, company number 04293930, registered office 80–81 St. Martin’s Lane, London, England, WC2N 4AA.  

In these terms, HOLBA, we, us and our mean Heart of London Business Alliance. 

3. Eligibility 

Unless stated otherwise, entry is open to current HOLBA member businesses only, and entry must be completed or submitted by an individual aged 18 or over who is authorised to respond on behalf of that member business. 

Only one entry or qualifying completion per eligible member business will be accepted unless the prize draw and incentive specific details expressly allow more than one entry. 

Employees, officers, workers, consultants and contractors of HOLBA, their immediate families, and anyone professionally connected with the administration of the survey or incentive are not eligible to receive an incentive unless the prize draw specific details state otherwise. 

Where the incentive is offered to a representative of a member business, that individual is responsible for ensuring that they have any employer permission required to enter, accept or keep the incentive. HOLBA may require evidence of such permission and may refuse or reallocate an incentive if acceptance would breach an employer policy, law, regulation, professional obligation or conflict-of-interest requirement. 

HOLBA may withhold or reallocate an incentive only where the participant has not met the clear eligibility or qualification criteria, or where participation or acceptance would breach these terms. 

4. No payment required 

No purchase, payment, donation or additional membership fee is required to enter a survey incentive promotion or to claim an incentive, unless expressly stated and lawfully structured in the prize draw and incentive specific details. 

5. How to participate 

To participate, eligible participants must follow the instructions in the prize draw and incentive specific details and have submitted prior to the closing or draw date. 

For guaranteed incentives, charity-donation incentives or incentives linked to “completed surveys”, a qualifying completion means a valid survey response. 

Entry into the competition constitutes acceptance of these terms and conditions. 

6. Incentive types 

HOLBA may offer one or more of the following incentive types. The relevant incentive type will be identified in the prize draw and incentive specific details. 

  • Prize draws - Where the incentive is a prize draw, winners will be selected at random from all valid eligible entries after the closing date.
  • Guaranteed incentives, gifts or vouchers - Where HOLBA offers a guaranteed incentive, gift, voucher or similar benefit, information will be provided on any conditions, quantity or availability limits apply.
  • Charity-donation incentives - Where HOLBA states that it will make a specified donation amount to a specified charity. HOLBA will only offer such incentives where the charitable purpose of that specified charity is in line with HOLBA’s governing documents or contractual agreements to authorise such monetary contributions. 

7. Winner or recipient notification 

Winners or incentive recipients will be notified within 30 days of the draw or closing date using the contact details supplied with the survey entry or otherwise held by HOLBA for the relevant member business. 

HOLBA will make reasonable efforts to contact the winner or recipient. If a winner or recipient does not respond within fourteen days of notification, HOLBA may select an alternative winner or reallocate the incentive. 

HOLBA is not responsible for failure to receive a notification where contact details are incorrect, out of date, incomplete, blocked by spam filters or no longer monitored. 

8. Announcement of winners and valid awards 

Where required by the CAP Code or other applicable rules, HOLBA may publish or make available information showing that a valid award took place. This may include the winning organisation’s name and location, or where an individual is the winner, their surname and county, unless the participant has objected or asked HOLBA to reduce the information made available. 

Participants may object to publication or request that the amount of information published or made available is reduced by contacting HOLBA at hello@holba.london in advance of the award or within five business days of being notified. 

No participant will be required to take part in publicity, photography, case studies, social media posts or press activity unless they have given separate permission. 

9. Survey responses, confidentiality and research use 

HOLBA may use survey responses for member engagement, research, policy, advocacy, business improvement, reporting, consultation, service design and related purposes stated in the survey invitation or privacy notice. 

Unless the survey states otherwise, HOLBA may use survey responses in aggregated or anonymised form, including in reports, board papers, member updates, stakeholder communications, presentations and external publications. 

Where individual comments are quoted, HOLBA will take reasonable steps not to identify the individual or member business unless permission has been obtained or the survey clearly states that identifiable responses may be used. 

If a survey is described as anonymous, HOLBA will not use incentive contact details to identify survey responses unless this is clearly explained before participation or is necessary to prevent fraud, administer the incentive, investigate a complaint or comply with law. 

10. Data protection 

HOLBA will process personal data in accordance with UK data protection law and HOLBA’s privacy policy at Our Data Promise | Heart of London Business Alliance 

11. Fair administration 

HOLBA will administer survey incentives fairly, transparently and in accordance with these terms. 

HOLBA may reject, remove or disqualify any entry that is incomplete, duplicate, automated, fraudulent, abusive, not submitted by an eligible participant, submitted in breach of these terms, or otherwise undermines the fair operation of the promotion. 

HOLBA may cancel, suspend, amend or withdraw a survey incentive only where it is necessary due to circumstances outside its reasonable control, technical failure, supplier failure, legal or regulatory concern, suspected fraud, or other exceptional circumstances, and only where doing so is fair to participants. 

12. Complaints and queries 

Any query or complaint about a survey incentive should be sent to hello@holba.london within five business days of submission or the closing date, whichever is the sooner. 

HOLBA will consider complaints reasonably and may ask for further information to verify eligibility, entry, completion, notification or fulfilment. 

HOLBA’s decision is final in relation to administration of the promotion, but this does not affect any legal rights or rights to complain to a relevant regulator. 

13. Governing law 

These terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales.
